The Seller – Refers to Holame Cakes that specializes in the sale of cakes online.
The Buyer – Refers to the Customer who wishes to purchase cakes through the Seller’s online platform, under the terms and conditions set forth;
- Products
The Seller agrees to sell cakes including, but not limited to, whole cakes (1kg onwards, including bento cakes), Cakelets (Small Cakes) And ShareMe (Shareable Cakes), via the Seller’s platform.
- Orders
2.1 Placing an Order: The Buyer shall place an order for cakes via the website. The order will include details pertaining to the cake type, size, specifications, delivery address, and contact information.
2.2 Order Confirmation: Orders will be confirmed via email communication upon successful payment.
- Pricing Information
3.1 The Seller will provide a pricing guide on the platform, which may be subject to change. Final prices shall be communicated and confirmed at the time of order placement.
- Deliveries/Shipping
4.1 Delivery Method: All whole cakes (1kg onwards, including bento cakes) shall be delivered using a car to ensure the integrity and prevent any loss or damage to the cake. The Seller will not accept requests for deliveries through any alternative means. For any alternative means, liability lies on the buyer incase of damage to the cake.
4.2 Delivery Timeline: Whole cakes shall be delivered the next day upon receipt of the order. Customized cakes that require additional time will be communicated clearly by the Seller at the time of order confirmation.
4.3 Delivery of Cakelets and ShareMe Cakes: The Seller also processes orders for cakelets, which shall be delivered on the same day or the next day depending on stock availability at the time of placing the order. Next day deliveries will be communicated clearly by the Seller at the time of order confirmation.
- Payment Terms
5.1 All payments shall be made in full at the time of order placement through secure payment processing options available on the website.
5.2 If an order is cancelled 24 hours prior to the delivery time, the Buyer may be entitled to a refund, minus applicable processing fees.
- Refund and Returns Policy
6.1 The Seller ensures the quality of the cakes delivered. However, if the Buyer finds any discrepancies or issues upon delivery, they must inform the Seller within 20-30 minutes of receiving the cake.
6.2 Any cakes returned or reported must be accompanied by proof of purchase. The Seller maintains the right to assess the condition and circumstances before processing any refund or replacement.
- Customer Liability
7.1 The Buyer assumes all responsibility for the cake once it is delivered, and the Seller shall not be liable for any loss or damage incurred post-delivery.
- Force Majeure
Neither party shall be liable for any failure to perform its obligations under this Agreement if such failure results from circumstances beyond its reasonable control (e.g., natural catastrophes, acts of government, etc.).
- Governing Law
This Agreement shall be governed by, and construed in accordance with, the laws of Kenya.
- Agreement Modification
No amendment, modification, or waiver of any provisions of this Agreement shall be effective unless in writing and signed by both parties.
- Severability
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, the other provisions shall remain in full force and effect.

We encourage you to review this Agreement periodically for any changes.
